1. Who we are, and what this is

FablePond (“FablePond”, “we”, “us”) is a subscription service operated by ACCTAN (“the Company”). It lets adults browse a curated library of illustrated children's stories and generate new personalised stories for children aged roughly 3–9.

These Terms form a binding agreement between you and ACCTAN. By creating an account, subscribing, or using FablePond in any way, you accept them. If you do not accept them, do not use the service.

2. Adult-only accounts

You must be 18 years or older to hold a FablePond account. You confirm this at signup with an explicit age attestation.

FablePond is a service used by adults, for children. There are no child accounts, no child logins, and no interfaces through which a child can enter information. Everything a child sees is opened for them by the adult account holder. If we learn that an account was created by someone under 18, we will close it and delete the associated data.

Reader profiles you create for children are not accounts. They are settings on your own account that tell us how to write for a particular child. What we store on them is deliberately minimal — see the Privacy Policy.

3. Acceptable use

You agree not to:

• Attempt to make FablePond generate content that is violent, sexual, hateful, frightening to children, or otherwise harmful — including by disguising such requests in free-text theme fields. We filter for this, both before generation and after, and repeated attempts may result in suspension or termination.
• Use another person's name, likeness or personal details in a story without their consent, or the consent of their parent or guardian.
• Resell, sublicense, redistribute, or commercially publish stories or illustrations obtained from FablePond.
• Scrape, crawl, bulk-download, reverse-engineer, or attempt to extract the underlying models, prompts or catalogue.
• Share your account credentials, or use one account to serve an organisation that should hold multiple licences.
• Interfere with the service's operation, security or availability, or circumvent rate limits and plan limits.

We may suspend or terminate an account for a material or repeated breach of this section. Where the breach is not serious and appears unintentional, we will normally warn first.

4. AI-generated content — what this means

Stories and illustrations on FablePond are generated by artificial intelligence and then reviewed by an automated safety layer before they are shown. You should understand:

• They are fiction, not fact. Stories may contain factual inaccuracies. Do not rely on them for factual information about the world, science, history, health or anything else.
• They are not an educational assessment. Age bands tune reading level and complexity, but FablePond is not a substitute for professional educational assessment or reading instruction.
• The safety layer is thorough but not infallible. Every story passes a dedicated safety review against a hard rule set before display, and stories that fail twice are never shown. No automated system is perfect. You remain the adult in the room: please preview content you are unsure about, and tell us immediately if something reaches your child that should not have. We treat those reports as our highest priority.
• Similar prompts may produce similar stories. Generated output is not guaranteed to be unique across users.

5. Content ownership and licensing

Stories you create

As between you and ACCTAN, you own the personalised stories you generate, and you may use them for personal, family and classroom purposes: reading them aloud, printing them, binding them, and sharing them privately. You may not sell them, publish them commercially, or distribute them at scale.

To the extent any rights in generated output vest in us by operation of law, we assign them to you for those purposes. Note that the copyright status of AI-generated material differs by jurisdiction and is unsettled in several; we make no warranty that generated output is protectable by copyright. The library catalogue

The curated library, its stories, illustrations, covers and metadata are owned by ACCTAN. Your subscription grants you a personal, non-exclusive, non-transferable, revocable licence to read them within FablePond for personal and classroom use. When you “star” your child in a library story, you receive the same personal-use rights in the resulting personalised version; the underlying illustrations and story structure remain ours.

The service itself

The FablePond name, logo, brand, software, design, prompts and pipelines are ours and are protected by intellectual property law. Nothing in these Terms transfers them to you.

Telemetry

We retain anonymised, non-identifying generation telemetry — such as which themes are chosen, how often a stage fails, and how long generation takes — to improve the service. This never includes children's names and is never used to build a profile of a child.

6. Subscriptions, billing and cancellation

FablePond offers a free tier and paid subscriptions (Premium and Family), billed monthly or yearly through Stripe. We never see or store your card number.

• Auto-renewal. Paid plans renew automatically at the end of each billing period at the then-current price for that plan, until you cancel. The renewal price, billing cycle and cancellation method are shown to you at checkout before you pay.
• Cancellation. You may cancel at any time from Settings. Cancellation takes effect at the end of the current period — you keep everything you have paid for until then. Cancelling is as easy as signing up: it is one click, in the same place, with no retention maze.
• No trial period. We do not offer time-limited trials. The free plan is open-ended instead: the free shelf stays available and you get three story creations every month, for as long as you like. Paid plans begin billing immediately on purchase, subject to the 14-day money-back guarantee in theRefund Policy.
• Price changes. We may change prices. Existing subscribers get at least 30 days' notice by email, and the change applies from the next renewal. If you do not want the new price, cancel before it takes effect.
• Refunds. See the Refund Policy, which forms part of these Terms.
• Failed payments. If a payment fails we will retry and email you. After the final failed attempt the account reverts to the free plan.

What happens to your content after cancellation

Your bookshelf stays readable forever. Every story you created remains in your account and remains readable, at no charge, whether or not you subscribe. We will not hold a family's stories hostage. What stops is creation: new story generation returns to the free-tier limit, library access returns to the free shelf, and premium features (narration, PDF download, bedtime mode, library personalisation) switch off.

If your plan's reader-profile limit decreases, profiles above the new limit become read-only rather than deleted. Their stories stay readable and nothing is erased.

7. Plan limits and fair use

Free accounts include a set number of story creations per calendar month. Reading is never metered on any plan. If a generation fails for any reason — including failing safety review — the creation credit is returned to you automatically; failed generations never cost you a credit and have no cash value.

“Unlimited” creation on paid plans is subject to fair use and technical rate limits: currently eight new stories per day on Premium and ten on Family, and three generations running at once. Starring your child in a story that already exists in our library does not count towards the daily figure. The limit is there to stop bulk and automated generation, not to ration ordinary family reading — if you have a genuine reason to go past it, email contact@acctan.com and we will sort it out. We will give at least 30 days’ notice by email before lowering this figure for an existing subscriber.

8. Suspension and termination

You may close your account at any time from Settings. We may suspend or terminate an account if you breach these Terms materially or repeatedly, if we are required to by law, or if continuing to provide the service would expose us or others to legal or safety risk. Where practical and lawful we will tell you why and give you a chance to fix it.

On account deletion, your data is erased as described in the Privacy Policy (hard deletion within 30 days, including stored illustration, audio and PDF files). Export your data first if you want to keep it — Settings has a one-click JSON export.

9. Availability and changes to the service

We aim for a reliable service but do not guarantee uninterrupted availability. We may modify, add or remove features. If we make a change that materially reduces the value of a paid plan, we will give notice and, where appropriate, a pro-rata refund.

10. Disclaimers

To the fullest extent permitted by law, FablePond is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing in these Terms excludes or limits any right you have as a consumer that cannot lawfully be excluded — including, in the UK and EU, statutory rights relating to digital content, and in Australia, the consumer guarantees under the Australian Consumer Law.

11. Limitation of liability

To the fullest extent permitted by law, ACCTAN will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising out of or in connection with your use of FablePond.

Our total aggregate liability arising out of or in connection with these Terms is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD 100.

This section does not limit liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited.

12. Your responsibilities

You are responsible for the accounts and content under your control, for keeping your sign-in secure, and for supervising the children who read stories from your account. You agree to indemnify ACCTAN against claims arising from your breach of these Terms or your misuse of the service. [COUNSEL: confirm scope of indemnity for a consumer service.]

13. Governing law and disputes

These Terms are governed by the laws of [COUNSEL: insert governing jurisdiction], without regard to conflict-of-laws rules.

[COUNSEL: arbitration clause placeholder.] If an arbitration clause is adopted, it must be drafted to comply with consumer-protection law in each operating jurisdiction, must not deprive EU/UK consumers of the right to bring proceedings in their local courts, and should include a small-claims carve-out and a clearly explained opt-out. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform.

Nothing here affects the right of a consumer resident in the EU, UK or Australia to bring proceedings in the courts of their own country of residence.

14. Changes to these Terms

We may update these Terms. For material changes we will give at least 30 days' notice by email to the address on your account and by a notice in the app before they take effect. Continued use after the effective date means you accept the updated Terms; if you do not, you may cancel and, where the change materially disadvantages you mid-term, request a pro-rata refund for the unused period.

15. General

• If any provision is found unenforceable, the rest remains in force.
• Our failure to enforce a provision is not a waiver of it.
• You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets, on notice to you.
• These Terms, together with the Privacy, Refund and Cookie Policies, are the entire agreement between us on this subject.
